Privacy Policy

Instinct Health Science (“IHS”) and iDiet want you to understand our practices with regard to collecting and using your information both online and offline and the steps IHS takes to safeguard it. We may amend this Privacy Policy from time to time and, when material changes are made, we will provide some indication of that on our main page. Please refer back to this Privacy Policy on a regular basis so that you will always know what information we gather, how we might use that information, and whether we will disclose that information to anyone. By enrolling in the iDiet Program, you agree to the terms of this Privacy Policy.

Personally Identifiable Information We Collect & How We Use It

“Personally Identifiable Information” means information that lets IHS know the specifics of who you are and can be used to identify, contact, or locate you. IHS may collect Personally Identifiable Information when you enroll in the iDiet Program, when you register on our website, when you request information about our services, when you correspond with iDiet staff, or when you otherwise volunteer information. Personally Identifiable Information might include your name, mailing address, telephone number, mobile phone number, email address, age, weight, weight loss goals, diet information, exercise information, and other identification and contact information. [Whenever IHS collects this information, IHS will attempt to provide a link or a written copy of this Policy so that you can confirm how this information will be used.] Personally Identifiable information also includes your computer’s IP address, locations you visit on our website, how long you stay at any given location on the website and other information about your use of the website.
We will use your Personally Identifiable Information to provide you with personalized services through the iDiet Program, customize the website for you and to otherwise optimize your and other customer’s experiences with our web and non-web-based services. We will share information about your weight, weight loss goals, program related activities and exercise with your iDiet Group Leader (program coach) for the purpose of helping you lose weight. Other than this unless you give us permission to do so, we will not sell, share, license, trade, or rent your Personally Identifiable Information except as specified in this Privacy Policy (as amended from time to time). Your email address will not be shared with any third parties.

Non Personally Identifiable Information We Collect & How We Use It

“Non Personally Identifiable Information” is information that does not identify a specific individual by itself or in combination with other information. This may include demographic information, such as age, profession, or gender, and health information, such as current weight. Non Personally Identifiable Information may also include information about what internet browser you are using, domain names, and other anonymous statistical data involving the use of our website. We will share anonymous information about your participation in the program with your [plan sponsor] so they may track the activities, exercise and weight progress of your group. We may compile and analyze this information on both a personal and an aggregated basis. We may use this information to help us understand who uses our website and to improve our website and the iDiet Program. We may use this anonymized information for academic research.

Cookies

Like many other commercial sites, our website utilizes standard technologies called “cookies” to collect information about how the website is used and to keep track of certain user information both during a user session on the site and from session to session over time. A cookie is a small data text file that a website stores on your computer’s hard drive (if your web browser permits) that can later be retrieved to identify you to IHS. Cookies are designed to help a website remember any preferences that may have been set while the user was browsing the site. Cookies can securely store a customer’s password, personalize home pages, or identify which parts of a site have been visited. The cookies we use cannot retrieve any other data from your hard drive, pass on a computer virus, or capture your email address. We also may use cookies to conduct marketing and promotional efforts, tailor certain advertisements to your browser that we think may be of interest to you, or to determine the popularity of certain content. We may link the information stored in cookies to Personally Identifiable Information you provide us, and to personalize your website experience we may store Personally Identifiable Information you provide us in an encrypted form in temporary or “session” cookies, which are erased when you close your browser. In addition to cookies that we place on your computer, cookies may also be placed on your computer by third parties that we use to display or serve advertisements or to collect Non-Personally Identifiable Information in order to provide advertising-related services. You do not have to accept cookies to use our website, but if you do not certain portions of our website may not function properly or may be unavailable to you. Although most browsers are initially set to accept cookies, you may reset your browser to notify you when you receive a cookie or to reject cookies generally. Most browsers offer instructions on how to do so in the “Help” section of the toolbar.

Disclosure Exceptions

Notwithstanding the policies above, IHS reserves the right to disclose your Personally Identifiable Information to appropriate third parties if IHS is required to do so by law or if IHS believes such action is necessary:
1. To comply with legal process such as a search warrant, subpoena, or court order;
2. To protect IHS’s rights and property;
3. To investigate reports of fraud or of users sending material using a false email address or users sending harassing, threatening, or abusive messages;
4. To protect against misuse or unauthorized use of the iDiet website; or
5. During emergencies, such as when IHS believes someone’s physical safety is at risk.

Message Boards and Chats

We may make message boards, chat rooms, and other interactive forums available as part of the website. You should be aware that any information which you post to these interactive forums or otherwise choose to make publicly available, including your Personally Identifiable Information, may be disclosed and available to all users who have access to that portion of the Site or Services. By using these interactive forums, you agree that we are not responsible for any information that you disclose or communicate in such forums, and any disclosures you make are at your own risk.

Use of Email

IHS will send you promotional email only if you have agreed to receive it. Your email address will be used only to respond to your request and for correspondence with iDiet staff regarding your participation in the iDiet Program. Your email address will not be shared with any third parties. Instructions for unsubscribing are included in every email containing promotional material.

Links to other Websites

Occasionally iDiet provides links on its website to other sites IHS thinks may be of value to you. These sites operate independently of IHS and the iDiet Program and have established their own privacy and security policies. IHS does not have any control over the privacy practices of these sites. For the best online experience, IHS strongly encourages you to review these policies at any site you visit.

Security

It is IHS’s intention to protect against the loss, misuse, or alteration of information that it has collected from you. IHS employs reasonable security measures to protect the security of the information you submit to us, but we cannot assure you that these measures will prevent unauthorized disclosure of, use of or access to your Personally Identifiable Information. IHS limits the information IHS provides to outside companies with whom IHS contracts to only what they need to carry out their responsibilities.

Privacy of Children on our Website

We are committed to protecting the privacy of children. It is our policy not to collect Personally Identifiable Information (as defined in the Children’s Online Privacy Protection Act) from any person under the age of 13. Our website and the iDiet Program are not designed for or directed to children under the age of 13. We do not collect Personally Identifiable Information from any person we actually know is under the age of 13, and we request that children under the age of 13 not submit any Personally Identifiable Information to us through the website. If we learn that we have inadvertently gathered Personally Identifiable Information from children under 13, we will attempt to notify such child’s parent or guardian and erase such information from our records, unless the child’s parent or guardian consents to our maintaining such information. We urge all parents and guardians to participate in their children’s exploration of the internet, and to teach their children about protecting their personal information online.

Policy Changes

If IHS makes changes to any terms in this Privacy Policy, the changes will be posted on this portion of the website so that you will always know what information IHS gathers, how IHS might use that information, to whom IHS may disclose it, and what choices you have. It is recommended that you review this page from time to time since each subsequent visit to the iDiet website will constitute acceptance of the Privacy Policy that is posted at that time, including any changes made since your prior visit.
